1. Introduction
These Terms of Service (“Terms”) govern your use of the FixFirst software, platforms, and services (the “Services”), provided by FixFirst (FixFirst.io).
By creating an account or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
These Terms apply to all users, including:
Consumers booking or managing repairs,
Repair providers using FixFirst tools,
Brands, cities, municipalities, NGOs, and other organizations running voucher schemes, sustainability initiatives, or white-label repair platforms using FixFirst.
These Terms are separate from the Repair Voucher Program Terms for specific public programs (e.g., London), which govern only those schemes.

3. Scope of Services
FixFirst provides software and digital tools that enable:
Repair providers to manage repair requests, customers, and transactions.
Consumers to book, track, and manage repair services.
Organizations (brands, cities, municipalities, NGOs, insurers, others) to launch and manage voucher programs, circular economy initiatives, and white-label repair platforms.
FixFirst acts solely as the software and platform provider.
We do not provide physical repair services. All repairs are performed independently by participating repair providers. Organizations remain solely responsible for their own voucher programs or initiatives.
4. Accounts & Registration
You must provide accurate information when registering and keep it up to date.
You are responsible for maintaining the confidentiality of your login credentials.
Business/organizational accounts must designate authorized users.
FixFirst may suspend or terminate accounts if fraudulent, abusive, or illegal activity is detected.
5. Subscriptions, Fees & Payments
Certain Services require a paid subscription or platform fee. Pricing and billing terms will be provided at purchase or contract.
Payments are processed via third-party providers (e.g. Stripe, PayPal, Apple Pay, Google Pay).
Subscription renewals are automatic unless canceled before the renewal date.
Fees are non-refundable unless required by law or by separate written agreement.
For voucher or white-label programs, commercial terms (e.g. funding, reimbursements, program setup) are governed by the specific agreement between FixFirst and the organization.
6. User & Organization Responsibilities
You agree to use the Services only for lawful purposes and in compliance with these Terms.
You must not misuse the Services, including attempting to hack, reverse-engineer, or disrupt functionality.
Repair providers are solely responsible for:
The quality, safety, and compliance of their repair services.
Organizations (brands, cities, NGOs, municipalities, insurers, etc.) are solely responsible for:
Defining and enforcing eligibility rules for voucher programs or initiatives,
Funding and managing reimbursements to repair providers,
Ensuring program compliance with applicable laws and regulations,
Accuracy of program information presented to end users,
Any contractual or legal obligations towards consumers and partners.
7. Intellectual Property & License
FixFirst retains all rights, title, and interest in the Services, including software, trademarks, and content.
We grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business or program purposes.
You may not copy, resell, sublicense, or redistribute the Services without prior written consent.
8. Data Protection & Privacy
Your use of the Services is subject to our Privacy Policy.
We implement appropriate technical and organizational measures to protect personal data.
When organizations use FixFirst to run programs or platforms, they may act as joint controllers or independent controllers of personal data. Responsibilities will be defined in separate agreements if required.
9. Third-Party Services & Integrations
The Services may integrate with third-party tools (e.g. payment gateways, AI providers, communication tools).
FixFirst is not responsible for third-party services, which are governed by their own terms and privacy policies.
10. Limitation of Liability
FixFirst provides the Services “as is” and does not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, FixFirst is not liable for:
Damages caused by repair providers, organizations, or third parties,
Indirect, incidental, or consequential damages,
Loss of data, business opportunities, or profits.
For voucher programs or organizational platforms, FixFirst is not responsible for program eligibility, funding, reimbursements, or compliance failures.
Our total liability under these Terms will not exceed the fees paid by you in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless FixFirst against claims, damages, or losses arising from:
Your violation of these Terms,
Your misuse of the Services,
Your repair services (if you act as a provider),
Your voucher program, initiative, or white-label platform (if you act as an organization).
12. Suspension & Termination
We may suspend or terminate access if you violate these Terms, misuse the Services, or fail to pay applicable fees.
You may terminate your account at any time.
Upon termination, your license to use the Services ends immediately.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Germany, without regard to conflict-of-law provisions.
EU/UK users retain mandatory consumer rights under their local laws.
Disputes shall first be resolved amicably via FixFirst support.
If unresolved, disputes may be submitted to arbitration or competent courts in Berlin, Germany.
14. Changes to Terms
We may update these Terms from time to time. Significant changes will be notified via email or platform notifications.
